Believe it or not someone can admit I stabbed the person but I didnt mean to kill them and that alone can bring the charge down to second-degree murder. The charge has to line up with the evidence. Unless police and prosecutors can clearly and unquestionably prove intent the initial charge will usually be second-degree murder.
