A California state appeals court on Tuesday, July 22, upheld a judge's refusal to vacate her first-degree murder conviction, ruling Lopez remains legally culpable under California's revised felony murder law. Lopez, who was described as a BDSM "slave," had attempted to distance herself from the crime, arguing she wasn't the actual killer or a major participant. Brittany was abducted, restrained, & brutally killed in 2012 after being lured to a home in Fallbrook under false pretenses. Her body was found days later, dumped in Riverside County. Prosecutors said she was the target of a sadistic fantasy shared by Lopez & her co-defendants, Louis Ray Perez & Dorothy Maraglino, all convicted of murder, torture, kidnapping, & attempted sexual battery, serving life without parole. Lopez's appeal rested partly on a change in state law allowing murder convictions to be overturned if the person wasn't the killer, didn't intend for anyone to die, or wasn't a major player. However, the appeals panel found Lopez "failed to show the evidence was insufficient" to support aiding & abetting the murder or a major role. The panel also dismissed her claim that her infamous handwritten confession letter, graphically describing the killing, was fabricated by Maraglino.
