Title VII of the 1964 Civil Rights Act clearly makes this expression of preference illegal. Given that an Uber driver is an independent contractor, and thus the rider is the de facto "employer", this would have to lead to prosecution of riders for expressing this preference, and to Uber as an accessory for facilitating it (unless we all just ignore the law).
