🔥 This lawsuit is a nightmare scenario for the Mountain West. Here’s why:

The MWC was banking on $150M+ in “poaching penalties” and exit fees from their departing schools to stabilize what’s left of their league (UNLV, Air Force, etc.). But the case is headed to trial after mediation failed.

⚖️ The antitrust elephant in the room: If a court finds the MWC’s exit and poaching penalties to be anticompetitive or unlawful - which many prominent attorneys point to the fact that they are (see unfair scheduling fees for OSU/WSU above the going rate $500k/vs $2M a game, discovery for the Gloria Naverez plan to try and split OSU and WSU against each other by taking WSU to MWC), the damages could be TRIPLED under U.S. antitrust law. That’s not just a $150M loss—it could spiral into $450M+ in damages that the MWC doesn’t have.

Expect MWC to settle though, because if it appears to get out of hand for them in court - there's no way they could afford the damages. 

đź’Ą If the Pac-12 wins:
âś… OSU & WSU keep those funds to rebuild around their 2026 expansion.
âś… SDSU, Boise, CSU, and others escape without financial baggage or discounted fees.
✅ UNLV & Air Force are stuck holding the bag in a gutted league—and may be even liable for damages as part of the MWC.

đź’Ą If the MWC wins:
✅ UNLV & AFA get their payday, but it won’t stop the Pac-12’s expansion juggernaut.
âś… OSU & WSU take a financial hit, but their 2026 roster is already locked in.

📉 Bottom line:
This isn’t existential for the Pac-12—they’re already deep into their rebuild. TXST assured the show goes on with the eighth football school. 

But for the MWC? A loss here would be catastrophic. They’d not only lose their poaching and exit fee windfall but could owe hundreds of millions in damages. Again, expect settlements per many attorneys that have commented.
