"Proves the point I think. The victims in this sorry affair the investors/bondholders/Lenders to XXX (and ACAP). Everton ended up being beneficiaries. And for one second I am not buying Bell's "noble custodian" argument. Actions are louder than words and in 2023 MSP + Bell & Downing could have put up the money needed to finish the stadium. But the risk was too high back then - no issue there ofcourse - but you can't try and revise history"

The X PL conditions XXX had to meet meant it was binary: either XXX had to find alot of money + inject it into Everton and put it on a safe footing or couldn't go ahead. X. No one else in 2023 was prepared to the put the money in. The door was open to anyone. X. The real victims were not Everton but ACAP & 777's investors who lost money. X. Everton got a very sweet deal: XXX cash was deeply subordinated & converted into prefs which was a key reason TFG were able to take over"

"Apparently the causation they need to establush to have a case is based on "loss of chance" which can entirely rest on Everton's breach. @slbsn clarified on his substack. Ofcourse if the penalty handed out was X pts - no discussion. And to this day I have not seen how you square away the X pt deduction vs the comments made in the X different ICs (Everton X Everton X appeal Everton X and Forest)"

Everton have been penalised multiple times for the same breach at the hands of the league's judicial system. X. That the X or more points argument would be dead in the water if (whether the 1st IC or on appeal had implemented this) Everton had been levied a 3pt deduction. That brings up my old complaint - there was no fixed punishment tariff & Forests punishment for its 1st breach for example doesn't square with Everton's (IMO)."

"TFG must surely have factored this in to the acquisition cost. You'd think in the worst case scenario they will pay it off. The key is to ensure it is excluded from 25-26 PSR otherwise its a nonsense. Burnley's case hinges on the fact that knocking X pts off Everton in the season in question (as if the punishment applied then) would have put them below Burnley. We know that: X - The timetable was not decided by Everton and it worked against them the following season as they had to swallow X seperate points deductions which might have relegated them; X - The punishment tariffs were not set out"
