"Fannie and Freddie sold billions of JPS in 2007 and 2008 before HERA was enacted. The JPS Liquidation Preference can be compromised if there is a HERA Receivership but otherwise the FHFA has the power not to pay dividends but does not have the power to compromise the stated value of the JPS. It does have the power to convert the SPS into common which I believe would be a Constitutional Takings. Of course this would be difficult litigation and there will most likely not be any actionable damages if the stock goes up - even a little at the time of the FHFA action"

"The UST has been on its cash advances plus XX% interest - somewhere in the neighborhood of $ XX to $ XX bn already. The SPS stated value and Liquidation Values are fictions - the SPS stated values should have been credited to retained earnings. If the SPS is written off it should be credited to retained earnings which are still have negative amounts - I think around $ XX bn for FNMA. Retained earnings for FNMA should be in the $ XX bn range and SPS should be the original $ X bn that was granted on the first day of Conservatorship"
