FREEDOM CONVOY PROTEST SENTENCING

The judge said right away he's not sending him to jail.

Guy Meister was a trucker protester found guilty of mischief and acquitted of obstruction due to the testimony of the officer who said Mr. Meister was cooperative.

Defense asked for a conditional discharge.

The judge said Meister was found guilty of mischief for blocking the intersection of [Rideau and Sussex?] and was arrested in the passenger seat of another, now-deceased trucker protester.

He was found guilty of mischief as a party.

The judge notes the effect of the protest on vulnerable people who use services downtown.

The judge takes notice of the defense argument that economic activity was reduced at the time due to mandates, but the impact was serious. Stopped people from going to work. The city was under siege.

This is not just a government city and the capital; it's a place where people live.

The judge says it was a mass mischief but he's not dismissing the right to protest; it's a free country. Rights however must consider others' rights.

Meister was a lesser player, not a leader; he's allowed his views. No two situations are alike. Different situations in other cases.

The crown seeks a conditional sentence of XX days and probation for XX months. The defence wants a conditional discharge.

The test has X components: 1st is if it's in the offender's interest to obtain a discharge. That's easy. It's in Meister's interest to be found guilty and not get a criminal record. The judge reads the guidance on this.

The judge says the second test is the effect on public interest, especially considering a reasonable, informed person's view.

Meister is pro-social, involved in the community, and has a strong family. Those are background. It was a mass mischief that took many people to accomplish. He is being sentenced for his role.
