Did you know that the birthright to US citizenship cases are all based on a landmark 1898 Supreme Court case?

And the credit goes to Wong Kim Ark, who challenged the “Chinese Exclusion Act” (1882).

Here’s the story:

He was born in San Francisco to Chinese parents. But when he went to China for a trip and came back, he was not allowed entry into the US, because the immigration authorities claimed he was Chinese.

He said, “No, I am an American.” And he took it all the way to the SCOTUS and won the decision, which was based on the 14th Amendment.

And till this day, United States v. Wong Kim Ark is the most compelling and quoted case in the birthright citizenship debates.
