And it gets even better… U.S. District Judge Waverly Crenshaw upheld the ruling from a magistrate judge which stated that Abrego Garcia should be released on bond while he awaits trial for flimsy human smuggling charges in Tennessee. Crenshaw stated that Trump’s Justice Department failed to prove that the Maryland father poses a threat to the community. They also failed to support their outrageous claim that he is a member of the violent MS-13 gang. “There is no evidence before the Court that Abrego: has markings or tattoos showing gang affiliation; has working relationships with known MS-13 members; ever told any of the witnesses that he is a MS-13 member; or has ever been affiliated with any sort of gang activity,” wrote Judge Crenshaw. “Based on the record before it, for the Court to find that Abrego is member of or in affiliation with MS-13, it would have to make so many inferences from the Government’s proffered evidence in its favor that such conclusion would border on fanciful,” he added. Shortly after Crenshaw’s ruling, U.S. District Judge Paula Xinis barred ICE from immediately taking Abrego Garcia into custody and ruled that he must be returned under supervision to Maryland where he and his family reside if he is released by U.S. Marshals. Xinis also ruled that ICE must give Abrego Garcia’s attorneys at least XX hours of advance notice if they plan on pursuing deportation proceeding to send him somewhere other than El Salvador. The Trump administration has been pursuing indiscriminate deportations by sending people to countries where they have no roots or connections. A 2019 court order already protects Abrego Garcia from deportation to El Salvador. “Defendants have done little to assure the Court that absent intervention, Abrego Garcia’s due process rights will be protected,” wrote Xinis, who has been overseeing Abrego Garcia’s civil lawsuit. Before Abrego Garcia can be released from the Tennessee jail a magistrate judge will consider his request to delay the transfer by XX days to give him and his lawyers time to plan his next moves. While this shameful saga is still far from over, these developments are encouraging. Trump is targeting this innocent father to pander to his racist, xenophobic base.
