The Development Bank of Namibia (DBN) has taken Enercon Namibia and its directors to the High Court to recover over N$28 million in unpaid loans.

According to court documents, the amount relates to two loan agreements signed between DBN and Enercon. 

The company is listed as the first defendant, while its directors, Peter Elindi and Malakia Elindi, are listed as the second and third defendants.

In the first agreement, DBN loaned N$18,075,000 to Enercon in May 2015. 

Only XX payments were made on this loan, with the last payment received in February 2024.

In the second agreement, also signed in May 2015, DBN provided over N$7 million to Enercon for a property loan. 

DBN says Enercon failed to meet monthly repayment terms on both agreements. 

As security, Peter and Malakia Elindi signed unlimited suretyships, and the defence company, August 26, also signed surety.

The legal action comes as the Elindi brothers are also facing charges in the ongoing NAMCOR corruption case.

During their bail hearing, they told the court that they took out bank loans to build accommodation for fuel attendants and constructed fuel facilities on properties owned by the Ministry of Defence.
