If those shares are held in a margin accounts, Schwab has the ability to pool and lend them out to short sellers, without compensating the actual shareholders. Schwab keeps XXX% of the lending fees. I've posted about this issue in the past, but it's worth repeating: one of the simplest ways shareholders can protect their investment is by taking ownership of their shares. That means moving them into a cash account or requesting book-entry form, both of which help prevent your shares from being loaned out against your interests.
