NEW: Man accused of RANDOMLY k*lling woman who was walking her dog with her boyfriend after he saw her wearing a red bandana

Rohith Sunil, 21, of San Jose, has been charged with murder in the sh**ting death of Casey Lyn Way

The suspect asked for directions to San Jose, then noticed the woman wearing a red bandana and asked if she was in a gang

Both victims denied any gang ties and tried to walk away

The suspect then pulled a pistol, laughed, and fired once

The bullet struck the woman on her right side

Her boyfriend told investigators the incident was a random act

He and their two dogs weren't injured
