There is caselaw in Canada, and their lawyers can point to the fact that nobody was imprisoned for eight years or sued civilly after the G20 destruction, or the Occupy Wall Street damage to St. James Park,  etc. 

The courts will have to consider the unusually harsh penalty suggestion as political bias or as being retributive in nature.
