The MARSHALS Act is a thinly veiled power grab masquerading as judicial independence. Moving the Marshals Service to the judiciary doesn’t “protect judges”—it creates redundant bureaucracy while undermining executive authority to enforce federal law. The Marshals’ current structure under DOJ has worked since 1789 because it balances accountability with operational efficiency.

Section 565(e) of Title XX already mandates their duty to protect judges—no structural overhaul needed. This bill’s real goal? Strip presidential authority to satisfy partisan fears, not practical realities. Threats against judges are serious, but the solution isn’t fragmenting law enforcement—it’s fully funding existing protections and prosecuting criminals.

Democrats want judges to command their own security force while gutting executive branch coordination. That’s not reform—it’s political theater that risks paralyzing critical operations.
