Earlier this year, #SupremeCourt held [Leela vs Muruganantham 2025 INSC XX that mere registration of a Will would not attach to it a stamp of validity and it must still be proved in terms of the legal mandates under Section XX Indian Succession Act and Section XX Evidence Act.

But recently, #SupremeCourt [ Metpalli Lasum Bai (D) vs Metapalli Muthaih (D) 2025 INSC 879] held that, when the Will is a registered document, there is a presumption regarding genuineness thereof and the burden would lie on the party who disputed its existence.

We got many queries pointing out a contradiction in these rulings.

However, we feel that there is no contradiction. When a Will is a registered document, there can be a presumption regarding genuineness (not validity) thereof. But its validity must be still proved by the propounder in terms of the legal mandate.
