It depends what the law says to decide if it rape.  So you are asking what I think.  I think it is a serious sexual assault, I am not sure if I would classify it as rape.  Actually I read the Federal Law does classify it as rape.  Not sure why New York is different.  I have no problem with the Federal Law.
