Given that Trump is a public figure, to prevail in his newly filed defamation action, he’ll need to prove that the defendants—Dow Jones, the WSJ, News Corp, Rupert Murdoch, and a few others—made false and defamatory statements, either with actual knowledge of their falsity or with reckless disregard for the truth

This “actual malice”standard is extraordinarily difficult to meet and stems solely from a 1964 Supreme Court decision—New York Times v. Sullivan—that essentially made up the rule out of thin air, wrongly claiming it was mandated by the First Amendment

The ruling has supercharged media outlets, granting them near-total immunity for negligently defaming public figures so long as they avoid knowingly lying or recklessly ignoring facts

Anyone care to guess which political party bears the brunt of this lopsided setup?
