they're not personally banned, but they lose their mandates. they could theoretically join another party and get on their list, I guess. 
a ban does not require parliamentary approval. It does require an application from either the Bundestag, the Bundesrat, or the government. The court in Karlsruhe receives this application and then rules on a ban.
