This is not true. In that (incorrect) news report they were comparing the Nintendo Account Agreement between the American one and the European one, however the EULA of Switch X (on the console itself) is different and is not available online as far as we know.

The EU EULA (attached below) also says that Nintendo can render your console unplayable.
