When someone drives drunk or at high speed, they know it’s illegal and that it can easily kill someone on the road or off the road. That awareness itself brings it under XXX Part II. The fact that people “aren’t supposed to sleep on the footpath” doesn’t shield the driver from liability. The law expects drivers to account for real-world risks. There could be pedestrians walking on the footpath or even beyond footparh. If you still choose to drive recklessly or drunk, you’re knowingly endangering lives, and that’s exactly what XXX Part II punishes.
