On November 5, 2014, Charles Merritt was arrested and charged with four counts of first-degree murder. Investigators concluded that Merritt likely attacked the family in their home on the evening of February 4, 2010. He then transported their bodies to the desert and later abandoned their vehicle at the border to create the illusion they had fled to Mexico.

Merritt’s trial began on January 7, 2019, in San Bernardino County. Prosecutors presented evidence of his financial motive, gambling debts, DNA found on the McStays’ vehicle, cell phone records placing him near the gravesite, and the fraudulent checks he had written after the family disappeared.

On June 10, 2019, the jury found Merritt guilty on all four counts of first-degree murder. On June 24, 2019, they recommended the death penalty. He was formally sentenced to death on January 21, 2020, and remains on death row at San Quentin State Prison.
