On June 13, 2012, police arrested Gerard and charged him with murder and interfering with a corpse. He was denied bail as a flight risk and because of the seriousness of the charges.

His trial began in June 2014. Prosecutors argued that Gerard’s financial problems, his affair, and his desire to move on without Allison pointed clearly to motive. The defense claimed the death was accidental. After weeks of testimony, including forensic evidence and accounts of his double life, the jury found him guilty on July 15, 2014. He was sentenced to life in prison with a non-parole period of XX years.

In 2015, Gerard appealed. The Queensland Court of Appeal downgraded the conviction to manslaughter, suggesting the possibility of an unintentional killing during a heated argument. The public reaction was swift and outraged. The Director of Public Prosecutions then appealed to the High Court of Australia.

On August 31, 2016, the High Court unanimously reinstated the original murder conviction, ruling that the jury’s verdict was justified by the evidence.
