Jennifer Guilbeault, 23, pepper-sprayed 45-year-old Shohel Mahmud in Manhattan

Guilbeault was initially charged with a hate crime but denied it was race-related

She entered a plea deal to a lesser charge of second-degree aggravated harassment

Her punishment includes XXX hours of community service, alcohol and anti-bias programs, and no arrests for a year

If she completes the terms, she can re-plead to a violation and avoid a criminal record
