The Environment and Lands Court ordered the cancellation of Shamji’s documents for the property originally allocated to the late Rajanikant Nathoobhai Shah in 1983. The court determined that Shamji and Paul Githaiga Ng’ang’a unlawfully obtained the title deed from Edward Nthuli who denied ownership and consent to the sale. Shamji's defense which included claims of legitimate ownership and development proved not enough as the court upheld the invalidity of Shamji's 2001 title deed and sided with Shah's estate represented by Arvinlal Nathoo Shah.
