"It is hard to gerrymander all those upstate and Western NY districts that have sig GOP populations. You can't use the 80-20 Dem majority in and around NYC to gerrymander the entire state. Oregon has the same problem -- XX% of the land mass in Oregon is conservative. Only the large population of the Portland Metro area allow it to be dominated by Dems. Everywhere south and west of Chicago is largely conservative. Illinois' map is ridiculous the way it drags GOP vote pockets from all over the state to make them part of Chicago area districts and make them meaningless. This is an art form"

"My views here ended up tracking pretty close with where the Ninth Circuit came out today on the Oregon case. Judge Nelson's concurrence in the Oregon case made the same point I made -- the Supreme Court's decisions in Mott and Luther make the President's exercise of discertion un-reviewable and if the Supreme Court wants to change that the Supreme Court can -- but lower courts cannot. I'll have an article out on the Ninth Circuit's decision tomorrow morning"
