"If Obergefell falls than nearly all of substantive due process seems under threat even Meyer v. Nebraska (marriage is a fundamental right.) Perhaps SCOTUS can distinguish but what about United States v. Windsor (social security benefits unequal application) Marriage as one man and one woman only hurts SCOTUS doctrinally on that equal protection holding. Kennedy opinions don't have a great track record. See Casey v. Planned Parenthood in which Kennedy changed the abortion rights game to be built on the most slender reed imaginable. I could talk shit about Kennedy opinions for hours"
