No, it's because the system isn't ready as well. Of course $TSLA would prefer to do like in Austin and move the safety monitor to the passenger seat, to give the impression of "no driver", and that difference IS because of regulatory matters.
However, the need for realtime safety monitoring is simply because the system isn't yet reliable enough.
