Okay. There's a technical difference I overlooked in the initial comment. However the hard fork had a roll-back effect by undoing transactions through a hard fork, redirecting stolen eth to a new contract.
Still contentious and sets a precedent to undermine immutability.. The precedent was set. Vitalik and co. could have done the same thing with the bybit hack but didn't; Arthur Hayes even encouraged it! Eth can alter its blockchain at will (Vitalik's will to be precise) through another 'irregular state transition' regardless of the terminology used..
