"Every act that others find out about has some speech component. If nothing else it communicates the idea that you thought you should do that thing. So the test for whether the First Amendment protects something because it's speech has to look at whether the primary purpose is to communicate ideas to people. If so it's not speech. I think the conduct at issue here usually won't pass this test. Its primary purpose is to control machinery to produce particular results. But I do accept that in some cases it will pass this first test. You just need to plead correctly. That's what went wrong here."
